The following is my Privacy and Consent information for counselling and psychotherapy clients.
The Data Controller & Processor: Shona Lowe
• the purposes and legal basis for processing client personal data: your personal data is kept solely in order to contact you and manage your case (such as health insurance report writing) while you are my client and for a period (see below) after we have finished our therapy work together. Records of our sessions are kept on hard copy paper notes only. These are stored securely in a locked cabinet when not in use.
• the circumstances in which data may be shared with other agencies. In line with my confidentiality policy, your personal data would only be shared with other agencies in the following circumstances: immediate risk of substantial harm to self or others; or under a legal requirement, e.g. terrorism, money laundering; or via court order for disclosure.
• Client records are kept for 7 years after the end of client work, and then those records are securely destroyed.
• If you correspond with me via email, please be aware that email may not be secure and that you would be using email at your own risk. This also applies to text messaging or mobile phone voicemail facilities. Please note: I do not keep any text messages, voicemails or emails once they are received and messages acknowledged.
• My laptop, used for storing contact details, is password protected and so are my electronic devices (e.g. mobile phone).
Your rights under data protection law: you have a right:
• to access a copy and explanation of your personal data
• to request correction or erasure of your data, in certain circumstances
• to request limiting or ceasing data processing, where applicable
• to compensation for substantial damage or distress caused by data processing, where applicable
I practice from a dedicated therapy consultation room at home in east Leeds.
